Judge Says
Partial Birth Abortion Is Gruesome, Barbaric,
Uncivilized And Causes Severe Pain.

In
today’s decision by Federal Court Judge Richard
Casey to strike the Partial Birth Abortion Act of
2003, Judge Casey wrote that partial birth
abortion is gruesome, brutal, barbaric, uncivilized
and causes the unborn severe pain.
Abortionists who do them are not concerned by
the pain they cause the unborn, nor do they think it
relevant to tell the aborting mothers of the pain this
will cause to their unborn children.
Judge Casey wrote "The Court finds that
the testimony at trial and before Congress establishes
that D&X [partial-birth abortion] is a gruesome,
brutal, barbaric, and uncivilized medical
procedure.” He
also said that there is "credible evidence that
[such] abortions subject fetuses to severe pain.
Notwithstanding this evidence, some of Plaintiffs'
experts testified that fetal pain does not concern
them, and that some do not convey to their patients
that their fetuses may undergo severe pain during a
D&X [partial-birth abortion]."
Judge Casey blocked the ban because it conflicted
with the Supreme Court’s 5-4 Stenberg ruling that
Roe v. Wade protects partial birth abortion.
In June, Judge Phyllis Hamilton rejected the
bill in part because it was deemed an undue burden.
She dismissed as irrelevant the excruciating
pain felt by the unborn during a Partial Birth
Abortion because a Dilation and Extraction (D & E)
abortion in which the child is dismembered in the
womb, would be equally painful.
Hamilton and abortion advocates believe that
this unnecessary and inhumane treatment of the unborn
should be left to personal choice.
The November election presents America with a clear
choice. A
switch of one justice would overturn Stenberg.
George W. Bush signed the Partial Birth
Abortion Ban saying "a terrible form of
violence has been directed against children who are
inches from birth."
John Kerry voted 6 times to oppose the ban on
this gruesome procedure.
John Kerry will appoint only judges who agree
with him. He
will ensure that these brutal partial birth abortions
will continue with the full force of the federal
government and eventually, with taxpayer funding.
